A legal notice to builder for delayed possession is a formal written demand served on a promoter who has missed the possession date fixed in the agreement for sale. It is drafted to Section 18 of the Real Estate (Regulation and Development) Act, 2016 and does three things: it puts the default on record, quantifies what the builder owes and fixes a deadline for compliance. The allottee elects one of the two remedies the statute offers, either staying in the project with interest for every month of delay until handover, or withdrawing with a full refund and interest. Homebuyers, NRI investors and the advocates who act for them serve this RERA notice as the first formal step before a complaint under Section 31.

When do you need this document?

The classic trigger is simple: the possession date, plus any grace period the agreement genuinely allows, has passed and no valid offer of possession has arrived. Most allottees wait far too long, relying on reassuring emails from the sales team that create no legal obligation. A notice converts a vague promise into a dated record of default, and the claim starts to take shape from that date.

A second situation arises when the builder sends an "offer of possession" without an occupancy certificate, or demands fresh charges for parking, club membership or cost escalation before handing over keys. The notice rejects the defective offer, disputes the unauthorised charges and keeps delay interest running until a lawful offer. Builders also invoke force majeure, but the Explanation to Section 6 limits it to war, flood, drought, fire, cyclone, earthquake or natural calamity. Funding gaps and labour shortages do not qualify.

If you withdraw, say so without ambiguity, because a notice that mixes possession and refund weakens the later complaint. Allottees who withdraw demand every instalment back with interest from each date of payment. One edge case worth flagging: an NRI allottee often acts through a relative holding a property power of attorney drafted under Indian law, and the notice must recite that authority or the builder will contest the sender's standing.

Key clauses included in our template

  • The identification of the parties and the project names every allottee, the promoter entity as registered and the project's RERA registration number. Joint buyers must all appear, or the omitted allottee's claim is open to challenge.
  • The recital of the transaction summarises the booking, the agreement to sell or registered agreement for sale, the unit and the contractual possession date, citing the exact clause relied on.
  • The statement of payments lists each instalment with its date and mode. RERA benches compute interest from each payment, so this schedule drives the claim.
  • The breach and statutory basis paragraph ties the default to Sections 18(1) and 19(4) and to the promoter's continuing duties under Section 11(4)(a).
  • The election of remedy comes in two alternative drafts: continuation with monthly delay interest until a lawful offer of possession, or withdrawal with refund, interest and compensation.
  • The computation and demand states the prescribed rate by reference to the State Rules, the principal paid and the period claimed, and fixes a compliance deadline of fifteen days from receipt.
  • The reservation of rights preserves a complaint under Section 31, compensation before the Adjudicating Officer under Section 71 and the consumer remedy, so the notice never reads as a waiver.

State-specific considerations

Maharashtra handles the largest RERA caseload in the country. Rule 18 of the Maharashtra Real Estate (Regulation and Development) Rules, 2017 fixes the rate at the SBI highest MCLR plus two per cent, and MahaRERA applies it as simple interest from the contractual possession date. Builders often answer a notice by proposing the MahaRERA conciliation forum, which is voluntary. Accept it only if the builder puts a written computation on the table. Warrants issued under Section 40(1) are executed through the Collector.

Uttar Pradesh, and especially the Noida and Greater Noida belt, produced the largest volume of stalled projects and the leading refund judgment, since Newtech arose from UP RERA orders. The Uttar Pradesh Real Estate (Regulation and Development) Rules, 2016 depart from the common formula, and UP RERA orders generally apply the SBI MCLR plus one per cent. Many UP promoters are in insolvency. Once a corporate insolvency process begins, the moratorium under Section 14 of the Insolvency and Bankruptcy Code, 2016 halts RERA proceedings, and allottees file claims with the resolution professional as financial creditors instead.

Haryana splits its Authority between Gurugram and Panchkula. Rule 15 of the Haryana Real Estate (Regulation and Development) Rules, 2017 adopts the SBI highest MCLR plus two per cent, and HARERA routinely strikes down agreement clauses capping delay compensation at a nominal per square foot figure. HARERA computes delay interest up to a valid offer of possession plus the two months allowed by Section 19(10). Compensation beyond interest goes to the Adjudicating Officer, so a Gurugram notice should keep both heads of claim distinct.

Karnataka allottees file before K-RERA in Bengaluru under the Karnataka Real Estate (Regulation and Development) Rules, 2017, which also follow the MCLR plus two per cent formula. K-RERA enforces its orders through recovery certificates sent to the Deputy Commissioner. Check the rate in your own State's Rules before quoting it, because a wrong figure invites a reply disputing the whole computation.

Common mistakes to avoid

The most frequent error is quoting the wrong interest rate: the token per square foot figure from the builder's agreement, another State's formula, or a rate applied to the full sale price instead of the amounts actually paid. RERA benches apply Section 2(za) and the State Rules, whatever the contract says. Equally damaging is a notice demanding possession, delay interest and a full refund in the same breath, since the allottee must make an election. Many buyers also serve the notice on a sales office rather than the promoter's registered office.

Keep proof of dispatch and delivery for every notice you send. Section 27 of the General Clauses Act, 1897 presumes service of a correctly addressed registered letter, but only if you produce the postal receipt and tracking record. Another costly mistake is signing the possession letter, an indemnity bond or the sale deed executed at conveyance without reserving your claim for delay interest in writing. Never sign a "no claims" undertaking at handover. Finally, waiting years weakens the case even though RERA sets no express limitation period.

Key takeaways

RERA remedy

Choose interest or refund early

Under Section 18(1) RERA, delay gives the allottee a statutory choice: stay in the project and claim interest for every month of delay until possession, or withdraw and seek refund with interest. The interest rate follows State RERA Rules, commonly SBI highest MCLR plus two per cent, on amounts actually paid.

Notice contents

Put the builder default on record

The notice should set out the booking, allotment letter, registered agreement for sale, payment trail and the promised possession date. It then records the breach, quantifies the amount claimed and gives the promoter a deadline to comply. Prior notice is not mandatory, but it creates evidence before a Section 31 RERA complaint.

Enforcement

RERA pressure is stronger than contract damages

This is not just a damages demand under Sections 73 and 74 of the Indian Contract Act, 1872. RERA adds statutory interest, a complaint route and recovery teeth: orders can be recovered as arrears of land revenue under Section 40(1), and a promoter appeal within sixty days generally requires deposit of the awarded amount.

Frequently Asked Questions

No. The Real Estate (Regulation and Development) Act, 2016 allows a complaint under Section 31 without any prior notice, and the Authority will not dismiss a complaint for want of one. Most advocates still send one. It fixes the date the builder was put on notice, records your election between possession and refund, and gives the promoter a last chance to settle before a hearing. A large share of delayed possession disputes close at this stage.

Yes. A legal notice has no prescribed statutory form, and its validity depends on its content and on proof of service, not on who drafted it. Our template states the facts, the breach of Section 18, the relief claimed and a clear deadline, which is what RERA benches and Consumer Commissions look for. You can send it in your own name or through an advocate on letterhead, and it becomes documentary evidence under the Bharatiya Sakshya Adhiniyam, 2023.

Fifteen days from receipt is the standard compliance period in Indian practice and the default in our template. Seven days can suit a case where the occupancy certificate is already issued and only the handover is pending. The statute prescribes no period, so the aim is a deadline a RERA bench would find reasonable. Count from delivery, not dispatch, and keep the tracking record as proof of receipt.

Yes, but not delay interest and a refund on the same unit. If you stay in the project, the Authority awards monthly interest until a lawful offer of possession. If you withdraw, it orders a refund with interest from each date of payment. Compensation for mental agony, rent paid elsewhere or lost opportunity is a separate head decided by the Adjudicating Officer under Section 71, applying the factors in Section 72.

The completed notice downloads immediately in Word and PDF. The Word version lets you or your advocate adjust wording and add a letterhead before signing. The PDF version is ready to print, sign and send by Registered Post AD or Speed Post, with the payment schedule and statutory citations already in place. Yes. Imperia Structures v. Anil Patni confirms that an allottee may choose the Consumer Commission under the Consumer Protection Act, 2019, since Section 88 of RERA preserves other remedies. The consumer complaint must be filed within two years of the cause of action under Section 69, although continuing delay often extends that period. RERA applies a fixed statutory rate and recovers through the Collector, while a Consumer Commission can award broader compensation. Pursue one forum at a time for the same relief.
