An internship agreement sets the terms on which a Hong Kong business takes on a university or post secondary student for a fixed placement: dates, allowance, supervisor, insurance and the paperwork that keeps the arrangement inside the exemptions of the Minimum Wage Ordinance (Cap. 608). Our template is drafted for hosts taking on student interns whose placement forms part of their programme and work experience students hired for a summer or gap period, with the 59-day exempt window and Employees' Compensation Ordinance (Cap. 282) cover written into the clauses. It gives SMEs, startups and NGOs a placement file that stands up to a Labour Department inspection.

What is an internship agreement in Hong Kong?

In Hong Kong an internship agreement is usually a contract of employment with a learning purpose attached. Once a student works under direction for an allowance, the relationship falls within the Employment Ordinance (Cap. 57), whatever the document calls itself. In a dispute, the Labour Tribunal applies the multiple factor test endorsed in Poon Chau Nam v Yim Siu Cheung (2007) 10 HKCFAR 156, where control and integration usually settle an intern's status. A sound internship agreement therefore records employment terms and proves the facts behind a statutory exemption from the minimum wage.

A Hong Kong employment contract built on the 417/468 rule suits a graduate trainee who has finished studying, or any placement that runs past the exempt window. A volunteer agreement under Hong Kong law covers unpaid help given freely to a charity. Between the two sits the observation placement, where a student shadows staff without producing work. No employment arises, yet the 2020 amendments to the sex, disability and race discrimination ordinances (Cap. 480, 487 and 602) protect the student as a workplace participant against harassment.

When do you need this document?

The classic case is the summer placement: a second year undergraduate joins a firm from June to August, and the host wants the first 59 days treated as exempt student employment. The internship agreement fixes the dates, records the student's age and enrolment, and annexes the declaration. The second scenario is the practicum that earns academic credit, common in nursing, social work and engineering, where the institution confirms student intern status for the whole placement, even a full semester.

A student who started an exempt winter job in January cannot start another exempt period in July, since the 59-day exemption is available once per calendar year across all employers. Unless the July role is a student intern placement, it pays at least the statutory minimum wage from the first day. A postgraduate already 26 at the start is not a work experience student, though a compulsory placement may still qualify under the student intern limb.

Key clauses included in our template

  • The exemption basis states whether the student joins as a student intern, as a work experience student or without exemption, and annexes the institution's document or the statutory declaration. It also carries a collection statement under the Personal Data (Privacy) Ordinance (Cap. 486) for the identity documents on file.
  • The placement period fixes the start and end dates and, for a work experience student, the exempt window counted in calendar days. A step-up clause lifts the allowance to at least the statutory minimum wage from the 60th day.
  • The allowance and wage period clause sets the amount, the wage period and payment within seven days of its end under section 23 of Cap. 57. Reimbursed expenses are kept apart from wages.
  • The supervision and learning objectives clause names a workplace supervisor, lists learning outcomes and commits the host to the institution's evaluation form. Placement offices routinely refuse endorsement without it.
  • The insurance and work injury clause confirms cover under section 40 of Cap. 282 and the display of the notice of insurance at the workplace. It also sets the internal steps for reporting an accident on Form 2 within the deadlines of section 15.
  • The confidentiality and intellectual property clause assigns rights in the reports, code and designs the intern produces. Section 14 of the Copyright Ordinance (Cap. 528) vests works in the employer only when made in the course of employment, so where status could be argued, add a standalone confidentiality and IP assignment deed for Hong Kong employees.
  • The termination and early recall clause sets a short notice period consistent with sections 6 and 7 of Cap. 57. It also lets the institution withdraw the student for academic reasons.

Student status and placement considerations

Students of local institutions qualify only if their institution appears in Schedule 1 to Cap. 608: the statutory universities and the Academy for Performing Arts, registered post secondary colleges (Cap. 320), Vocational Training Council bodies (Cap. 1130) and, for post secondary programmes only, schools registered under the Education Ordinance (Cap. 279). A school leaver taking a summer job after the HKDSE is not a work experience student, even with a university offer in hand, because enrolment must exist when the employment starts.

Hong Kong residents at non-local institutions qualify under the non-local programme limb, provided the full-time programme leads to a degree or higher. An overseas undergraduate not resident in Hong Kong fits neither definition, so the minimum wage applies, and visitor conditions of stay rule out any employment, paid or unpaid, without an employment or training visa. The host must inspect the travel document of any non-permanent resident under section 17J of the Immigration Ordinance (Cap. 115), and section 17I punishes employing anyone not lawfully employable.

Non-local students at Hong Kong institutions work under the No Objection Letter issued by the Immigration Department. Internships must relate to the curriculum and be arranged or endorsed by the institution, capped at one academic year or one third of the programme length, whichever is shorter, at undergraduate level and above. Sub-degree students are limited to mandatory placements of up to six months, and exchange students generally cannot take internships. Temporary relaxations exist for degree students, so the internship agreement records the letter's actual conditions.

How to fill out this internship agreement

You start by choosing the exemption route: student intern, work experience student, or a placement paid at the statutory minimum wage throughout. A work experience placement then asks for the student's date of birth, the start date and the last day of the 59-day window, counted in calendar days, while a student intern placement asks for the institution, the programme and the placement officer signing the confirmation. You then enter the allowance, wage period, supervisor, notice period and the insurer and policy number for the employees' compensation cover, and choose the confidentiality and IP options. The finished internship agreement downloads in Word for edits and in PDF for signature. Sign it before the first working day, attach the confirmation or declaration, and keep a copy where a Labour Department inspector can see it.

Common mistakes to avoid

The most frequent error is treating the title of an internship agreement as an exemption in itself. Without the institution's document or the student's declaration on file, the host cannot justify an allowance below the statutory rate. Arrears go to the Labour Tribunal, and wilful non-payment of wages is an offence under section 63C of Cap. 57. The second error is counting working days: the 59-day window runs in calendar days, so a placement starting on 1 June ends its exempt period on 29 July. Hosts also try to split an exempt period across two contracts, but unused days cannot be carried forward, and a declaration produced after the start date leaves the exemption exposed.

The insurance mistake is the most expensive. Hosts assume a short placement sits outside Cap. 282 and then face an injury claim with no insurer. Others label the intern a freelancer; a student working set hours under a supervisor is an employee, and an independent contractor agreement drafted to the Poon Chau Nam indicia will not change that. Finally, extending a 59-day placement by a few weeks brings in the minimum wage and, at 60 days, MPF enrolment, with employer contributions counted from the first day of employment.

Key takeaways

Exemption route

Minimum wage exemption is narrow

The agreement must show which Cap. 608 route applies. A student intern needs an institution-arranged or endorsed placement forming part of a full-time accredited programme. A work experience student must be enrolled in that kind of programme and be under 26 when the contract starts. Calling someone an intern will not, by itself, avoid minimum wage rules.

59-day rule

One exempt window per calendar year

For a work experience student, the parties may agree a continuous exempt period of up to 59 days under section 3 of the Minimum Wage Ordinance (Cap. 608). Only one such period may commence in a calendar year. The student must give the employer a statutory declaration, and the host should keep the paperwork ready for Labour Department inspection.

Other duties

Insurance and wages still apply

A minimum wage exemption does not switch off the Employment Ordinance (Cap. 57) or Employees' Compensation Ordinance (Cap. 282). Wages are due at the end of each wage period and must be paid within seven days. Under section 40(1) of Cap. 282, employing anyone without proper employees' compensation insurance can trigger prosecution, even for a short placement.

Frequently Asked Questions

Yes, unless the placement fits an exemption in section 7 of Cap. 608. A student intern can receive whatever allowance the parties agree for the whole placement. A work experience student can be paid below the statutory rate only during an agreed continuous period of up to 59 days. Any other student, including a school leaver or a non-resident overseas undergraduate, must receive at least the statutory minimum wage from day one.

Only where there is genuinely no employment relationship. A student who observes and shadows staff without producing work is not an employee, so neither Cap. 57 nor Cap. 608 applies. Once the student takes on real tasks under direction, the Labour Tribunal will usually treat the arrangement as employment whatever the label, and the unpaid weeks become a wage claim. A modest allowance under a written internship agreement is the safer structure.

Before the contract of employment commences. Under the Oaths and Declarations Ordinance (Cap. 11), the work experience student declares that no other exempt period has commenced in the same calendar year and that none will commence before the new contract starts. It is made in person before a justice of the peace, a notary or a commissioner for oaths. Ask for it a week before the start date and annex it to the internship agreement.

Yes. Once signed, it is an enforceable contract of employment, and section 70 of Cap. 57 voids any term that reduces the statutory minimum standards. No stamping or registration is required, and the Electronic Transactions Ordinance (Cap. 553) allows electronic signatures for this contract. The student's declaration is different, because Schedule 1 to that Ordinance excludes statutory declarations from electronic execution. A version countersigned by the institution is optional and does not replace its separate confirmation.

Yes, both formats are generated as soon as you complete the questionnaire. The Word file takes the adjustments a placement office or your HR team may request, such as a different evaluation schedule or a bilingual signature block, while the PDF is the clean copy for signature and your inspection file. If the same hire needs another document, the full catalogue of Hong Kong legal templates works the same way.

Plan it before the exempt period ends. For a work experience student, the statutory minimum wage applies from the 60th day, and MPF enrolment follows at 60 days of employment. A graduating student joining as staff needs a fresh contract with probation and full continuous contract terms; if it follows the internship without a break, service will generally count as continuous. The Hong Kong employment and HR templates cover the offer and the permanent contract.
